Terms of sale

1. Scope

These terms apply to Yomax services: building websites, apps and digital solutions, hosting, maintenance and changes. They are intended for business clients (tradespeople, shop owners, freelancers, companies and associations).

2. Quote and order

Each service is covered by a free, detailed quote, valid for 30 days. The order is confirmed when the dated and signed quote is returned with the words “bon pour accord” (approved). The quote sets out the content, price, timeline and payment terms; it prevails over these terms in case of difference.

3. Prices

Prices are in euros, net: VAT not applicable, article 293 B of the French Tax Code. “From” prices shown on the website are indicative; only the price in the accepted quote is binding on both parties.

4. Payment

Payment terms and due dates are set in the quote. Payment is made by bank transfer or another method stated on the invoice. Final launch takes place after payment of the balance set in the quote.

5. Delivery and timeline

Once the mock-up is approved, Yomax delivers the service within the timeline stated in the quote, usually 3 to 4 weeks for a showcase website. This timeline assumes the client provides the requested content (copy, photos, access); any delay in providing it shifts the timeline accordingly.

6. Client obligations

The client provides accurate content to which they hold the rights (copy, photos, logos, brands), and indemnifies Yomax against any claim related to that content.

7. Approval and delivery

Edits are unlimited until the mock-up and the website are approved before launch. Launch counts as delivery. After launch, the first change is free; further changes cost €30 each, except with the “admin area” plan.

8. Hosting, domain name and support

The “hosting and support” subscription (€10 per month or €100 per year) includes the domain name, secure hosting, technical maintenance and Google review updates. It is subscribed with a 12-month commitment. After this period, it can be stopped, effective at the end of the paid period. The domain name is managed by Yomax during the subscription; when it ends, it is transferred to the client with the website files, on simple request.

9. Ownership

Once the price is paid in full, the client owns the content created for them and may freely use their website. Yomax keeps its tools, methods and reusable generic elements. Unless the client refuses in writing, Yomax may show the work as a reference (screenshots, name, link).

10. Liability

Yomax has an obligation of means. It cannot be held liable for an interruption caused by a technical provider (host, domain registry, third-party services), force majeure, or a change made by the client or a third party. Its liability is limited to the amount paid for the service concerned.

Data processing is described in the legal notice.

12. Disputes

These terms are governed by French law. In case of disagreement, the parties first seek an amicable solution; failing that, the dispute is brought before the competent courts.
